SPP hikes protection for disabled minors

China's procuratorial authorities are strengthening legal protection for minors with disabilities by using case-based supervision and cross-departmental coordination to address difficulties in accessing education, medical assistance, compensation and long-term development.

The Supreme People's Procuratorate and the China Disabled Persons' Federation recently released seven typical cases related to protecting the rights and interests of minors with disabilities. The cases cover issues such as traffic accident compensation, access to education, abandonment and relief, and medical damage claims.

The SPP said the cases show how procuratorial organs can use legal supervision to protect vulnerable minors and respond to public concerns with stronger rule-of-law support.

One case highlighted cross-departmental coordination. In April 2024, a county procuratorate in Jiangxi province received a tip-off that the local education bureau had improperly distributed subsidies for students with disabilities.

After inspecting records with education authorities and the disabled persons' federation, prosecutors found that 52 eligible students had not received subsidies, while three ineligible students had received more than 10,000 yuan ($1,470) in subsidy funds.

Prosecutors filed an administrative public interest litigation case and issued a pre-litigation recommendation. The bureau soon recovered the improperly paid funds, and worked with the local disabled persons' federation to review the subsidy program.

The 52 eligible students later received 156,000 yuan in subsidies. A follow-up review in September found no further problems.

The cases also show that prosecutors are looking beyond immediate relief to the long-term development of minors with disabilities.

In one sexual assault case, a girl, who was 13 at the time and had an intellectual disability, was assaulted by a man surnamed Li in April 2023. A county procuratorate in Fujian province prosecuted Li in October that year, and the local court sentenced him to prison for rape the following month.

While handling the case, prosecutors visited the victim's family and learned that she had athletic talent. The local county's disabled persons' federation worked with her special education school to design a tailored training plan and arrange professional coaching. After two years of training, she won a silver medal at the National Games for Persons with Disabilities in 2025.
